लखनऊ : हाई कोर्ट ने यूपी के मुख्य सचिव को आदेश दिया है कि सरकारी विभागों से रिटायर कर्मचारियों के बकाया पेमेंट के मामले तीन माह में निपटाए जाएं। कोर्ट ने यह भी कहा है कि मुख्य सचिव ऐसे मामलों की रिपोर्ट मंगवाकर देखें। पेमेंट लटकाने वाले संबंधित विभागों के अधिकारियों की जवाबदेही भी तय की जाए।
लघु सिंचाई व भूजल विभाग से 31 अगस्त 2015 को रिटायर हुए बाबू राम ने बकायों का भुगतान न होने पर याचिका दायर की थी। इस मामले में कोर्ट ने विभाग के प्रमुख सचिव को दो माह में पेमेंट करने के आदेश दिए हैं। डबल बेंच ने कहा कि ऐसे कई मामले पेंडिंग हैं। अधिकारी थोड़ा भी ध्यान दें तो ऐसे मुकदमों का बोझ न बढ़े।

The petitioner retired, while working on the post of Assistant Engineer on 31.08.2015 but till date he has not been released the post retiral dues even after one and a half years had passed. Since, no post retiral dues has been paid to the petitioner, he represented to the respondent no.1 i.e. Principle Secretary, Minor Irrigation and Ground Water Department of the State Government on 18.03.2017 but till date his grievance has not been addressed. Since, the petitioner has already been made a representation for payment of post retiral dues to the respondent no.1, which has to be examined on the basis of the facts available with him, it would be appropriate to issue direction to respondent no.1 to take decision on the petitioner's representation dated 18.03.2017 and released the post retiral dues expeditiously, preferably within two months from the date of communication of this order.
During the course of dealing with the service matters, it has come to our notice that a number of cases are pending in this Court with regard to the payment of post retiral dues as well as a number of alike requests are pending with the Government but no heed has been paid by the concerned officers. Whereas if even the least care is taken by the concerned officers of the department, this Court would not be over burden with such cases. Therefore, we would like to make an observation for the Chief Secretary, State of U.P. to call for the report from each and every department how many cases with regard to payment of post retiral dues are pending consideration and if there is no legal impediment a direction be issued to the concerned department to dispose of those matters within shortest period, which may be maximum three months. We are informed that the State Government has already issued the Government Order to this effect stipulating the period for payment of post retiral dues but the instructions issued by the State Government are not being adhered to by the officers in strict sense. Therefore, we would like to observe that the Chief Secretary of State shall fix the responsibility of the erring officers if such lapses are found on their part.
Let the copy of this order be provided to the Chief Secretary of the State Government for issuing necessary direction and take action thereon expeditiously.
With the aforesaid observations, the writ petition stand disposed of.
